1. Acceptance of Terms

By accessing or using the LottoPatternLab website (lottopatternlab.com) and any associated services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("Player", "you", or "your") and LottoPatternLab ("we", "us", or "our"). Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Eligibility

To use the Service, you must meet all of the following eligibility requirements:

  • You must be at least 18 years of age. Gambling is strictly prohibited for anyone under 18. We reserve the right to request proof of age at any time and may suspend or close accounts where age verification cannot be confirmed.
  • You must be a resident of Australia and physically located within a jurisdiction where participation in lottery games is lawful.
  • You must not be self-excluded from gambling services via BetStop (the National Self-Exclusion Register) or any state-based exclusion program.
  • You must not be a person prohibited from gambling under any applicable Commonwealth, state, or territory law.

We may conduct identity verification checks in accordance with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and applicable regulations. Failure to provide satisfactory identification may result in account suspension.

3. Account Registration

To participate in games offered through the Service, you must create a registered account. When registering, you agree to:

  • Provide accurate, current, and complete information as prompted during the registration process.
  • Maintain and promptly update your account information to keep it accurate and current.
  • Maintain the confidentiality of your password and account credentials. You are solely responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorised use of your account or any other breach of security.
  • Register only one account per person. Multiple accounts held by the same individual may be closed, and any associated winnings may be forfeited.

We reserve the right to suspend or terminate any account at our discretion, including where we reasonably believe a breach of these Terms has occurred.

4. Game Rules

LottoPatternLab operates a lottery-style game governed by the following rules:

  • Number Selection: Players select 6 numbers from a pool of 45 (numbered 1 through 45). Numbers may be chosen manually or generated automatically via the Quick Pick feature.
  • Draw Schedule: Official draws are conducted on Tuesdays and Saturdays at 20:30 AEST, unless otherwise notified.
  • Winning Determination: Winning numbers are determined by an independently audited random number generator. Results are final and binding once officially published on the Service.
  • Entry Fees: The cost per game entry is displayed at the time of purchase. All entry fees are non-refundable once a draw has been conducted.
  • Supplementary Numbers: Supplementary (bonus) numbers may be drawn in accordance with the applicable game rules and prize structure as published on the Service.

Full game rules, including prize divisions, odds tables, and draw procedures, are available on the Service and form part of these Terms. In the event of any conflict between these Terms and the specific game rules, the specific game rules shall prevail.

5. Prize Claims

Prize claims are subject to the following conditions:

  • Prizes must be claimed within six (6) months from the date of the relevant draw, unless a longer period is specified by applicable law.
  • Prizes up to and including $1,000 AUD will be credited directly to your registered account.
  • Prizes exceeding $1,000 AUD may require additional identity verification and may be paid via electronic funds transfer to a nominated Australian bank account.
  • Major prizes (over $50,000 AUD) will be paid following completion of a verification process, which may take up to 14 business days.
  • All prizes are paid in Australian Dollars (AUD). Tax obligations, if any, are the sole responsibility of the prize winner. We recommend seeking independent tax advice.
  • We reserve the right to withhold prizes pending investigation where fraud, collusion, or a breach of these Terms is suspected.

Unclaimed prizes after the claim period will be dealt with in accordance with the Gambling Regulation Act 2003 (Vic) and directives from the Victorian Gambling and Casino Control Commission (VGCCC).

6. Responsible Gambling

LottoPatternLab is committed to promoting responsible gambling. We expect all players to gamble responsibly and within their means. By using the Service, you acknowledge and agree that:

  • Gambling should be viewed as entertainment, not as a way to make money.
  • You are solely responsible for any money you spend on the Service.
  • You may set voluntary deposit limits, loss limits, and session time reminders through your account settings.
  • You may request temporary or permanent self-exclusion from the Service at any time by contacting our support team.
  • We may intervene if we observe gambling patterns that suggest harm, including contacting you or imposing cooling-off periods.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio, video, software, data compilations, and the design, selection, and arrangement thereof, are the exclusive property of LottoPatternLab, The Lottery Corporation Limited, or their licensors and are protected by Australian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The LottoPatternLab name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of The Lottery Corporation Limited. You must not use such marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Service without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010):

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses.
  • Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.
  • We are not responsible for any losses arising from system failures, internet connectivity issues, or circumstances beyond our reasonable control (force majeure).

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

9. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using the Service, you consent to the collection and use of your personal information as described in the Privacy Policy, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions.

The Service operates under the regulatory oversight of the Victorian Gambling and Casino Control Commission (VGCCC), established under the Victorian Gambling and Casino Control Commission Act 2011 (Vic). We comply with all applicable requirements of the Gambling Regulation Act 2003 (Vic) and any licence conditions imposed by the VGCCC.

You irrevocably submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia in relation to any dispute arising out of or in connection with these Terms.

11. Dispute Resolution

In the event of a dispute arising from or in connection with these Terms or the Service, the following process applies:

  1. Internal Resolution: You should first contact our customer support team via our Contact page. We will endeavour to resolve your complaint within 14 business days.
  2. Escalation to Management: If the matter is not resolved to your satisfaction, you may request escalation to our disputes manager, who will review the matter and provide a written response within a further 14 business days.
  3. External Resolution: If the dispute remains unresolved, you may refer the matter to the Victorian Gambling and Casino Control Commission (VGCCC) at vgccc.vic.gov.au or contact the Victorian Civil and Administrative Tribunal (VCAT).

Nothing in this clause limits your right to commence legal proceedings at any time.

12. Modifications

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Notify registered players via email or through an in-Service notification at least 7 days before the changes take effect.
  • Provide a summary of the material changes made.

Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and close your account.
